ARTICLE 1: OBJECT
These general conditions of use (the “T&Cs”) govern the use of the Site by any user, natural person, whoever they may be, aged at least sixteen years (“You”).
They aim in particular to define the conditions under which You can:
- access and navigate the Site;
- publish comments (the “Customer Reviews”)
By browsing the Site, You acknowledge having read and fully and unreservedly accepted the T&Cs.
PASSIAMAN reserves the right to modify the T&Cs at any time. They will then be applicable as soon as they are put online. As such, we invite you to read the T&Cs regularly.
ARTICLE 2 - ACCESS TO THE SITE
The Site is open to any Internet or mobile user meeting the conditions set out in Article 1, subject to having a connection to the Internet network.
However, the creation of a customer account is necessary if You wish to place an order on the Site. If applicable, we invite you to refer to the General Conditions of Sale.
ARTICLE 3 - CUSTOMER ACCOUNT
Your customer account allows you to:
- place order
- view and update your contact details
- view the history of your last orders
To create your customer account, You must complete a registration form including your contact details (title, surname, first name, postal and email address, telephone) and create your personal password. You will then receive an email confirming the creation of your customer account and listing all of your customer data.
By creating your customer account, You undertake to provide accurate, complete and up-to-date information.
It is specified that your identifiers (email address or customer number and password) are under your entire responsibility. It is therefore your responsibility to ensure the confidentiality of this information, and to report any fraud or hacking to PASSIAMAN customer service as soon as possible.
To delete your customer account, You are invited to contact PASSIAMAN customer service in accordance with the provisions “Your rights of access, modification and deletion” in the “Personal Data” tab of the Site. It is specified that PASSIAMAN may also be required to delete a customer account which does not have any orders in progress due to regulations relating to personal data.
ARTICLE 4 - PERSONAL DATA
The personal data collected on the Site will be subject to computer processing. You are invited to refer to the “Personal Data” tab of the Site to obtain all the information relating to this point.
ARTICLE 5 - INTELLECTUAL PROPERTY
All elements of the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. Likewise, the brands, logos, designs and models appearing on the Site are the exclusive property of PASSIAMAN. Their disclosure cannot in any way be interpreted as granting any license or right to use any such trademarks and distinctive elements protected by copyright. They cannot therefore be used under penalty of counterfeiting.
Therefore, none of the materials from the Site may be copied, reproduced, republished, downloaded, posted, transmitted or distributed in any way whatsoever.
However, one copy of the materials may be downloaded to one computer for your personal and non-commercial use only, provided that you do not modify the information contained therein and that you keep intact all copyright and other proprietary notices. Modification of these documents or their use for another purpose constitutes an infringement of PASSIAMAN's intellectual property rights.
If you have a personal website and wish to place, for personal use, on your website a simple link directly to the home page of the Site, you must request authorization from PASSIAMAN. This will in no case be an implicit affiliation agreement.
On the other hand, any hypertext link referring to the Site and using the framing or in-line linking technique is strictly prohibited. In all cases, any link must be removed upon simple request from PASSIAMAN.
ARTICLE 6 – LIABILITY
PASSIAMAN undertakes to ensure the proper functioning of the Site, however it cannot be held responsible for any inconveniences or damages inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.
PASSIAMAN will make its best efforts to prevent Customer Reviews contrary to legal or regulatory provisions and more generally these T&Cs from being accessible on the Site. Customer Reviews are published under the full and sole responsibility of their authors; PASSIAMAN cannot be held responsible for content of which it is not the author.
ARTICLE 7 – DISPUTES
The T&Cs are subject to French law. The competent court in the event of a dispute will be that of the defendant's place of residence.
The Site complies with French legislation, and in no case does PASSIAMAN give any guarantee of compliance with the local legislation which may be applicable to you, when You access the Site from other countries.
